Non-Dischargeable Debt: Recent Taxes

Recent taxes are one form of non-dischargeable debt in Utah bankruptcy cases. This includes federal, state and municipal taxes that became due within the past three years. However, there are potential solutions that you can explore in regards to your Chapter 7 or Chapter 13 bankruptcy case, and a Salt Lake City bankruptcy attorney at our firm can help explain these to you.

The Stone Law Firm is comprised of a team of highly skilled attorneys and legal professionals who are dedicated to representing clients’ interest in bankruptcy cases throughout all of Salt Lake City, Ogden and Provo, Utah. Your options in regards to your taxes will vary depending upon your particular situation and whether you file for a Chapter 13 or Chapter 7 bankruptcy. During a free initial case evaluation with a lawyer at our firm, we can address your questions in this regard and see how we may be able to help you.

How Chapter 7 and Chapter 13 Bankruptcy Affect Recent Taxes

In a Chapter 7 case, you may be able to have your taxes discharged if you meet the following criteria (however, it is possible that the time periods listed below may vary):

  • Your tax return was filed properly and accurately (you did not try to avoid paying taxes)
  • Your tax return was filed more than 2 years prior to your bankruptcy petition
  • Your tax return was due at least three years before the date of filing your bankruptcy petition
  • The taxes were assessed at least 240 days before the date you filed your bankruptcy petition

In a Chapter 13 case, you would formulate a plan to repay your recent taxes over a three to five year period, by making a single regular payment to the bankruptcy trustee, who will then distribute the payment among creditors. Once you file your Chapter 13 petition, all tax penalties will stop accruing. This alone can save you a lot of money on your taxes.
